Do Federal Gambling Laws Interfere With State Betting Options?

Sports betting is the one form of gambling entertainment in the United States in which the Federal Government has enacted laws to prevent. Until 2018, the PASPA law prevented 46 US-states from enacting sports betting legislation until the Supreme Court decided that the ban was unconstitutional. The only states that were exempted from PASPA were Nevada, Oregon, Montana, and Delaware.

Since that monumental court decision, all states are now allowed to enact sports betting laws as they choose. And enact domestic sports betting they have. Many states have already passed sports betting laws and feature physical sportsbooks as well as mobile betting apps.

The Federal Wire Act prohibits the use of US-based online sportsbooks across state lines, though it does not apply to online sportsbooks licensed and regulated outside of the United States. In fact, offshore sportsbooks are not mentioned in any of the federal laws applicable to gambling in the US.

Residents of most US states can legally bet on the Super Bowl through licensed and regulated offshore sportsbooks like the ones we’ve recommended on this page. Some Americans can now also use domestic sportsbooks if the service is available in their state. The exception is the state of Washington which has imposed bans on all online gaming.

US States Offering Regulated Domestic Super Bowl Betting

Several states have already started offering domestic sports betting at their casinos and racetracks and other states are rushing to get operations going before the NFL football season. Below you can find a comprehensive list of which states are friendly toward Super Bowl betting and at what type of venue it is available.

While most states do not include laws or regulations concerning betting at offshore sportsbooks, it is also not illegal in most cases. The only exception is Washington which officially prohibits all online gambling. These prohibitions are historically unenforced, but residents of WA are advised to proceed at their own risk.

You can also legally bet on the Super Bowl by using a state-licensed sportsbook if you live in a state that has already legalized online sports betting and has wagering services up and running. These include Nevada, New Jersey, West Virginia, and
Pennsylvania, with several other states pending launch.

States Where It Is Illegal To Bet On The Super Bowl

While federal laws do not mention licensed offshore betting in their language, state laws must be considered before placing any types of bets. Most states do not enforce any sort of legal action against licensed offshore betting, as there are no laws against it.

However, there is one exception: Washington has state laws that explicitly mention online gambling sites as being illegal. These laws prohibit all online betting, regardless of the source.

Now, enforcement may be loose within WA, but the laws are still there. Is it likely that in Washington State you will be confronted for betting on Super Bowl odds online at an offshore sportsbook? No. Is it impossible? Also no.

We do not condone any sort of illegal activity. Our sole purpose is to provide information on the most reputable and legitimate online sports wagering options. If you are a resident of Washington, betting through any type of online sportsbooks is done at your own risk.

New Jersey has not outlawed offshore sports betting, however, they make it their personal mission to keep those sites away from residents of the Garden State. This being the case, most of the trusted online sportsbooks promoted on this site do not accept bettors from New Jersey.

Outside of these three states, most regions are not as aggressive towards offshore gambling. Our team of sports betting analysts has compiled a table of all 50 states and their stance on offshore betting. Pay attention to which ones are lenient towards the offshore market and which states are not. Knowing how the state laws apply to your region can make all the difference between staying within your legal confines.

Yes, US states are now allowed to offer sports betting if they choose to enact laws to allow the service. The Supreme Court of the United States ruled that the PASPA act was unconstitutional in 2018 and since states have been moving fast to enact sports betting laws before the 2018 NFL regular season.

Now that PASPA is out of the way, only the Federal Wire Act and the UIGEA prevents US-based online sportsbooks across state lines. Those two laws are likely to be challenged in the near future but for now, domestic sports betting laws are spreading across the United States.
